Return and Refund Policy
Right of withdrawal
DIPERSIDE PA is committed to ensuring full Customer satisfaction. Pursuant to Article 52 of the Consumer Code, the Customer has the right to withdraw from the contract by returning the Products – with the exception of those customized and/or purchased at a special price (discounts, promotions) – purchased through the diperside.com website within 14 (fourteen) days from the date of receipt.
To exercise this right, the Customer must send an email to the address: info@diperside.com, including the following information:
1 An explicit declaration with which you express your intention to exercise the right of withdrawal, in accordance with Article 52 of the Consumer Code;
2 The precise indication of the Products for which you intend to exercise this right;
3 The progressive order number communicated by DIPERSIDE PA at the time of purchase confirmation.
In the event of exercising the right of withdrawal, DIPERSIDE PA will provide a full refund of the price of the Products, provided that they are returned by the Customer within 14 days of exercising the right and that they are in the following conditions: unworn, unused, undamaged, accompanied by the original receipt and packaged in the "DIPERSIDE" packaging.
DIPERSIDE PA reserves the right to refuse the return in the event that the Products do not comply with the requirements indicated above. In the presence of defective Products, the provisions of paragraph 3 "Defects of conformity" will apply. The refund will be made using the same payment method used for the purchase, while the price of the Products purchased online cannot be refunded through physical stores.
The costs for returning the Products will be borne by the Customer.
DIPERSIDE PA undertakes to proceed with the refund without unjustified delays and, in any case, within 14 days from the date of receipt by the company of the withdrawal notice, as provided for by art. 54 of the Consumer Code. At the same time, a notification will be sent via email to the Customer at the time of the refund.
It is recommended to ship the Products to be returned via a courier, insuring the total value of the goods and keeping the tracking number to allow tracking of the shipment. DIPERSIDE PA cannot be held responsible for any failed refunds or compensation relating to Products shipped by the Customer that do not reach their destination due to loss, theft or damage not attributable to the company.
Once the Product has been shipped, the order cannot be cancelled or modified. However, it will be possible to return the Products according to the conditions on the right of withdrawal described above.
Product Replacement
DIPERSIDE PA offers Customers the possibility of replacing the Products purchased through the Site. If the Customer is not fully satisfied or finds a discrepancy with the order placed, he/she must keep all the documentation relating to the delivery and the Product itself in the original packaging, then immediately contact DIPERSIDE PA by email at the address: info@diperside.com, following the procedure indicated in the previous paragraph.
The Product to be replaced must reach DIPERSIDE PA in its original state of dispatch, in accordance with the provisions of the previous paragraph.
Please note that, in the replacement procedure, the amount paid by the Customer will initially be refunded using the same payment method used for the purchase (as indicated in the general conditions paragraph), and then a new transaction will be carried out.
The fulfillment of the new order will be subject to the availability of the requested Products.
Shipping costs for returning the Product will be borne by the Customer.
Defects of Conformity
In the event that a Product sold by DIPERSIDE PA presents a manufacturing defect or a lack of conformity, the Customer must immediately contact online assistance at: info@diperside.com, within 24 hours of receiving the order.
The legal guarantees provided for in Articles 129, 130 and 132 of the Consumer Code apply to the sale of the Products. The Customer has the right to restore, without charge, the conformity of the goods through repair or replacement or, if these remedies are not effective, to a proportionate reduction in the price or to the termination of the contract. This right will lapse if the Customer does not report the defect to DIPERSIDE PA within 24 hours of discovery. Furthermore, the action aimed at asserting defects not fraudulently concealed by DIPERSIDE PA expires, in any case, within 24 (twenty-four) hours of delivery of the goods.
Errors or Inaccuracies
DIPERSIDE PA undertakes to keep the information relating to the description and/or sale of the Products on the Site updated, trying to ensure that the photographic and descriptive representation faithfully reflects the Products themselves. However, given the digital nature of the presentation, discrepancies may occur between the Customer's perception and the actual product. DIPERSIDE PA reserves the right to correct errors, inaccuracies or omissions even after sending an order proposal and to update the information at any time without notice.
